Warranty Exemption

In this section you will find information on the exclusion of warranty. Hama does not assume any liability for open source programmes.

Disclaimer

To the extent that this is permitted by law, Hama assumes no liability for open source programs. Unless otherwise confirmed in writing, the copyright holders and/or third parties provide the program “as it is”, without any guarantee, either explicit or implicit, including – but not limited to – the implicit guarantee that it is ready for the market or can be used for a certain purpose. The end user bears the full risk in terms of the program’s quality and performance. If the program is faulty, the end user shall bear the necessary costs for service, repair or correction.

Limitation of Liability

Under no circumstances, except when required by the applicable laws or guaranteed in writing, shall any copyright holder or third party who modified or transferred the program as allowed by GNU/GPL be liable to the end user for any damages, including any general or specific damages, damages caused by side effects or consequential damages resulting from the use of the program or inability to use the program (including – but not limited to – data loss, faulty data processing, losses borne by the end user or other parties, or the inability of the program to work in combination with any other program), even if a copyright holder or third party had been informed of the possibility of such damages.
